Costa del Sol Rental Market: What the Housing Decree Rejection Means

Spain's latest housing measures have taken an unexpected turn after Congress rejected the government’s housing decree by 178 votes to 172. The vote means the measures introduced in the decree will not continue, including several proposals that would have directly affected short-term rental properties.

What Changes for Holiday Rentals?

For property owners across the Costa del Sol, one of the most relevant points was the proposed 10% VAT on certain short-term rentals of up to 30 nights. The decree also included the possibility of higher IBI charges for tourist-use properties in certain areas. These measures now fall with the rejection of the decree.

The proposed changes to seasonal and room rentals also do not move forward at this stage. For owners and investors, this means that the national measures contained in the rejected decree do not become part of the new framework.

What Does It Mean for Marbella?

For the Costa del Sol property market, the immediate picture is therefore one of continuity rather than a new national tax regime.

However, owners should remember that existing Andalusian regulations, local requirements and tourist-rental registration rules continue to apply. The rejection of the decree does not remove the need to comply with the regulations already in force.

A Market to Keep Watching

The vote also highlights how quickly the regulatory environment around property and holiday rentals can change in Spain.

For international buyers considering Marbella or the wider Costa del Sol, understanding both the property market and the local regulatory framework remains an important part of making an informed investment decision.

For now, the proposed national changes have been stopped — but the debate around housing, rentals and tourism in Spain is certainly continuing.
